In prosecutions for violations of section 42-139, 42-144 or 42-145 of this article,
it is a rebuttable presumption, where relevant, that the person with whom the charged
individual is alleged to have performed the prohibited act is not an employee. It
is an affirmative defense, where applicable, that the individual involved in the alleged
violation is an employee with whom the otherwise prohibited act is allowed.
